The Committee members emphasized, that the Bill (Reg. No. 2141) envisages amendments to Article 84 of the Civil Procedural Code and Article 90 of the Code on Administrative Legal Proceedings of Ukraine, as well as to chapters "Final and Transitional Provisions" of these Codes, according to which marginal rate of compensation of expenses for legal aid will be defined by the Cabinet of Ministers of Ukraine.
In the Committee members´ opinion, the essence of the introduction of marginal rates of compensation of expenses for legal aid is to provide guarantees concerning securing of one´s right for legal aid, i.e. concerning securing of constitutional right of citizens.
At the same time, People´s Deputies stressed that Decree of the Cabinet of Ministers of Ukraine №607-р of the 8th of December 2006 approves the Concept of the Bill "On Marginal Rate of Compensation of Expenses for Legal Aid".
Granting this and supporting the opinion of the Central scientific and expert administrative board of The Verkhovna Rada of Ukraine Secretariate that introduction of marginal rates of compensation of expenses for legal aid should be settled by means of enactment of relevant law, the Committee has upheld a decision to forward the Bill to the subject of law of legislative initiative for further elaboration.
